These General Conditions of Use (“Conditions”) govern access to and use of the My Transactions Tracker website and application available at mytransactionstracker.com (the “Service”), operated by My Transactions Tracker (“we”, “us”, or “our”). By creating an account, signing in, or otherwise using the Service, you agree to these Conditions.

1. Purpose of the Service

My Transactions Tracker provides tools for real estate professionals and related parties to manage transaction information, documents, communications, timelines, and related workflows. The Service is a productivity and record-keeping platform; it does not replace licensed legal, brokerage, escrow, title, or tax advice.

2. Eligibility and accounts

You must provide accurate registration information and keep your credentials confidential. You are responsible for activity under your account. Notify us promptly at support@mytransactionstracker.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Conditions or applicable law.

3. Acceptable use

You agree not to misuse the Service, including by: uploading unlawful, infringing, or harmful content; attempting to gain unauthorized access to systems or other users’ data; interfering with Service integrity or security; scraping or reverse engineering except as permitted by law; or using the Service to send spam or deceptive communications.

4. Your content and data

You retain rights to content you upload (transaction details, documents, messages, and similar materials). You grant us a limited license to host, process, display, and transmit that content solely as needed to operate and improve the Service and to fulfill your instructions (for example sharing with collaborators you authorize). You represent that you have the rights and consents needed to upload and process the personal data you enter.

5. Confidentiality and professional duties

Transaction files may contain confidential client and deal information. You remain responsible for complying with your brokerage policies, licensing rules, confidentiality duties, and applicable privacy laws when using the Service.

6. Third-party services

The Service may integrate with third-party providers (for example email, MLS or property data, storage, AI document assistance, or push notifications). Their terms and privacy practices apply to their services. We are not responsible for third-party outages or decisions.

7. Availability and changes

We strive for reliable availability but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features with reasonable notice when practical. Continued use after changes to these Conditions constitutes acceptance of the updated Conditions when we post a revised “Last updated” date.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that outputs (including AI-assisted extractions or calculations) are complete or error-free; you must verify critical figures and documents independently.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or business opportunities arising from your use of the Service. Our aggregate liability for claims relating to the Service is limited to the fees you paid us for the Service in the twelve (12) months before the claim, or one hundred U.S. dollars (USD $100) if you have paid no fees.

10. Indemnity

You agree to defend and indemnify us against claims arising from your content, your misuse of the Service, or your violation of these Conditions or applicable law, except to the extent caused by our willful misconduct.

11. Privacy and cookies

Processing of personal data is described in our Privacy Policy. Use of cookies and similar technologies is described in our Cookie Policy. Where required, we request your consent for non-essential cookies via our cookie banner.

12. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Conditions, legal risk, or prolonged inactivity. Provisions that by nature should survive (including liability limits, indemnity, and intellectual property) will survive termination.

13. Governing law

These Conditions are governed by the laws of the State of California, USA, without regard to conflict-of-law rules, except where mandatory consumer protections of your place of residence apply. Courts located in California will have exclusive jurisdiction, subject to those mandatory protections.
